Dear Mr. Nigro:

CWA Local 1081 submits this Step II Class Action Contractual Grievance to protest the fact that the exit stairwell on the westernmost side of the privately-owned 18 Rector Street/10 Park Place, Newark edifice is being utilized to store musical instruments thus impeding the safety of our Union’s members as they take that particular stairwell to enter and exit the building.

Attached, please find the following photographs CWA Local 1081 took of the offending condition Monday, April 28, 2008:

Picture #1 reveals parts of a drum kit lying on the floor at the bottom of the stairs within the cited stairwell.
Picture #2 reveals a snare drum and a tom tom drum lying on the floor at the bottom of the stairs within the cited stairwell.
Picture #3 reveals a full-sized electric piano positioned near the drum kit mentioned within number one of our Union’s three points made herein.

Based upon the thick layers of dust existent upon all of the musical instruments carelessly and callously strewn about the stairwell, as depicted, the instruments have either not been utilized for some time and have been purposely therefore stored there and/or the musicians to whom they belong do not exercise apt harmonious hygiene.

The resolution CWA Local 1081 respectfully demands to this grievance is for the above referenced musical instruments to be removed from the stairwell and stored elsewhere within an area not of potential harm to our Union’s members.

CWA Local 1081 seeks a hearing, in this regard.
