Re: Step I Class Action Contractual Grievance
Untimely and Unreasonable OIS Work Assignments
Article I. Purpose
Article IV. Work Schedules and Overtime
Article V. Seniority and Job Vacancies
Article VII. Discipline
Article XXV. Non-Discrimination

Dear Mr. Crawley:

CWA Local 1081 submits this Step I Class Action Contractual Grievance on behalf of our Union's Family Service Worker members assigned to the Office of Intake Services (OIS), located within the Military Park office, to protest the lateness in the day our applicable adversely affected members' intake application assignments have been received by them and the failure by management to take into account seniority when making assignments within the OIS.

As per the attached memoranda and client affidavit, all dated December 4, 2013 and faxed out Union, the Case Banking practices as applied to the OIS have proved a fundamental failure at the expense of our members and their clients alike .

The resolution CWA Local 1081 respectfully demands to this grievance consists of the following:

The County shall immediately cease and desist its Case Banking practices.
The County shall cease the assignment of clients so late in the day to our members working within intake so as to compel them to either cut short their contractually requisite lunch breaks, give short shrift to their clients' interviews and/or or to violate clients' confidentiality by purported supervisory suggestion.
The County shall henceforth abide by Article V. Seniority and Job Vacancies of our Union's contract with the County of Essex when selecting FSW's for new/special projects within the OIS.

We seek a hearing in this regard.

Sincerely,

David H. Weiner, President
