SUBJECT: PEOSH Inspection Report

As you will recall, CWA Local 1081 had filed the following documents complaining about the presence of raw sewerage within the basement, or "Lower Level", of the County-owned 50 South Clinton Street, East Orange building:

On May 30, 2013, a Step I Class Action Contractual Grievance " on behalf of all of our Union's adversely affected clerical members assigned to Food Stamp Citizen Services Center to protest their being managerially directed to continue to file within an area that today experienced a backup and spillage of raw sewage within the filing room area that was formerly the site of the kitchen."
On June 5, 2013, a "Public Employees Occupational Safety and Health Complaint" with the State of New Jersey Department of Health regarding the above cited spillage of the raw sewerage.
On June 20, 2013, a Step II Class Action Contractual Grievance "on behalf of our Union's members assigned to work within the Food Stamp Citizen Services Center" "to protest the fact that the County has failed to post a completed version of the attached Certificate of Posting PEOSH Notification of Alleged Hazard(s) issued by the New Jersey Department of Health as the result of our Union's attached complaint to PEOSH regarding 'Raw Sewage Seepage Within the Lower Level' of the East Orange facility."
On July 22, 2013, a withdrawal of the June 20, 2013 Step II Class Action Contractual Grievance since the County had (subsequently to our Step II Class Action Grievance of June 20, 2013) posted the Certificate of Posting PEOSH Notification of Alleged Hazard(s).

Please see the attached letter of August 22, 2013 written Essex County Executive by the State of New Jersey Department of Health noting that the State had first inspected the basement on July 2, 2013 based upon our Union's complaint (accompanied by two of our Union's Shop Stewards assigned to the Food Stamp office) and (based upon a subsequent inspection on August 19, 2013) had found that the County's violation had been abated and the case has been closed.
