Dear Ms. Guarini:

CWA Local 1081 submits this Step III Class Action Contractual Grievance, on behalf of our Family Service Worker members approved by the County of Essex to attend the Rutgers University Executive MPA Program, to protest Director Davis' ostensible refusal to not charge them their own time for the days they will have spent in classroom instruction. Ms. Davis is purportedly insisting they use their respective vacation time.

Director Davis' attached Step II Class Action Contractual Grievance denial response of June 25, 2013 is unacceptable to CWA Local 1081 and to our Union's applicable members. For Ms. Davis to callously, and coyly, deny the merit of our grievance because our Union had "not provided a list of the affected individuals" is spectacularly spurious inasmuch it is only she and her minions whom would possess the entirety of that specific information. However, in order to comply with Ms. Davis' ridiculous requirement, CWA Local 1081 has today submitted the attached OPRA (Open Public Records Act) request to the County which will result is Ms. Davis having to provide the "list of the affected individuals" to OPRA Custodian Al Fusco whom in turn will provide the list to our Union. CWA Local 1081 will then provide the "list of the affected individuals" to Ms. Davis in order to satiate her demonstrably demeaning dictate.

As you will please be informed, our Union successfully grieved this matter last year as per the attached Step II Class Action Contractual Grievance of June 26, 2012 and the email message Essex County Director of Human Resources Alan Abramowitz at that time sent me supporting our stance that our applicable members did not have to use their vacation days to attend the MPA classes.

The resolution CWA Local 1081 respectfully reiterates to resolve this grievance consists of the County abiding by its previous pledge, and past practice, to have our above referenced Union members afforded County time for the week they shall have spent in classroom instruction.
