Local Fiscal Affairs Law (N.J.S.A. 40A:5-1 et seq.), Et Al

Dear Mr. DiVincenzo:

CWA Local 1081 respectfully submits this request our Union be provided the following documents relative to the Local Fiscal Affairs Law and the County of Essex.

The Local Fiscal Affairs Law regulates the non-budgetary financial activities of local
governmental units. An annual independent audit of the local governmental unit’s accounts for the previous year must be performed by a New Jersey licensed Registered Municipal Accountant. The audit, conforming to the Division’s “Requirements of Audit”, includes recommendations for improvement of a local governmental unit’s financial procedures and must be filed with the Director within six months after the close of its fiscal year:

Our Union is requesting a copy of the Audit Report of the County of Essex for the years 2010 and 2011.
Our Union is requesting a copy of the synopsis of the Audit Report, together with all recommendations made which were to have been published in a local newspaper within thirty days of their completion, for the years 2010 and 2011 as well as respective copies of the newspaper publishing's.
Inasmuch as the chief financial officer of every local governmental unit also must file annually with the Director a verified statement of the financial condition (the “Annual Financial Statement”) of a local governmental unit as of the close of the fiscal year, our Union is requesting a copy of the verified statement of the financial condition of the County of Essex for the years 2010 and 2011.
Inasmuch as the chief financial officer of every local governmental unit must also file annually with the Director an Annual Debt Statement which is amended for each new authorization of debt by type and amount, our Union is requesting a copy of the Annual Debt Statement of the County of Essex for the years 2010 and 2011.
Inasmuch as Each local governmental unit must adopt a cash management plan and is to deposit its funds pursuant to that plan, our Union is requesting a copy of the cash management plan of the County of Essex for the years 2010 and 2011.

In addition to the above delineated requests for documents, CWA Local 1081 respectfully requests the following of the County of Essex regarding Mr. Mark E. Acker whom has served its Director, Department of Administration since August 15, 2011:

A copy of Mr. Acker's Bachelor of Business Administration in Finance document of 1976 from Temple University.
A copy of Mr. Acker's Master of Business Administration document of 1983 from Rider University.
A copy of Mr. Acker's Certified Municipal Finance Officer document of 1978 from Rutgers University.
A copy of Mr. Acker's Certified County Finance Officer document of 1993 from Rutgers University.
A copy of the documentation of Mr. Acker's salary when he first was hired by the County of Essex and his present salary.0
