Dear Mr. Nigro:

 

CWA Local 1081 submits this Step II Class Action Contractual Grievance on behalf of all of our Union’s members assigned to the OCSE unit located on the first floor of the Hall of Records to protest the fact that the time clock located immediately outside ASFS Yvonne Cooper’s office is inaccurately set a full five minutes ahead of the actual time. This fact, which I personally confirmed during an investigatory visit to that office I made on July 8, 2009, has resulted in a number of our members being improperly cited for tardiness and inequitably suffering disciplinary and financial sanctions.

 

As you will please recall, CWA Local 1081 filed the attached Step II Class Action Contractual Grievance of May 5, 2009, entitled “Automated Time and Attendance Records Keeping System, Proved Flaws and Resultant Inequitable Dockings and Discipline” which you summarily denied on May 18, 2009, and the attached Step III Class Action Contractual Grievance of May 22, 2009 identically titled which Director Anibal Ramos denied on June 2, 2009. As you will please recall as well, CWA Local 1081 on June 5, 2009 requested the National CWA Union file for arbitration regarding that matter involving the flawed Automatic Time and Attendance System in which we delineated other examples of the unreliability of the agency’s defective time clock system’s modus operandi.

 

The resolution CA Local 1081 respectfully demands to this grievance consists of the following:

 

  1. The County shall arrange for the errant time clock to be reset to reflect the actual time of day.
  2. The County shall arrange for the making whole of all members of CWA Local 1081 who suffered disciplinary and financial sanctions during the period the time the clock has been improperly set.

 

We seek a hearing, in this regard.
