Re: Step II Class Action Contractual Grievance

       Article I. Purpose

       Article VII. Discipline

       Article XXII. Health and Safety

        Article XXV. Non-Discrimination

       Article XLIX. Safety of Staff

Dear Mr. Nigro:

CWA Local 1081 submits this Step II Class Action Contractual Grievance, on behalf of all of our adversely affected and potentially adversely affected members employed by the Essex County Division of Welfare, to protest the County’s apparent failure to place a sufficient number of fire extinguishers within the Mobile Citizen Services Office. In addition, the one small fire extinguisher I observed on June 12, 2009 lying upon the floor within the rear of the vehicle had no inspection tag attached to it with which to ascertain when, or if, the extinguisher had ever been inspected. As the resolution to this grievance, CWA Local 1081 respectfully demands the following:

1.      A Health and Safety Committee meeting shall be soon scheduled in order to enter the Mobile Citizen Services Office and review the vehicle regarding all health and safety matters.

2.      An appropriate number of sufficiently sized fire extinguishers shall be immediately properly deployed upon the Mobile Citizen Services Office, with tags, and said extinguishers shall be inspected regularly as required by law.

Sincerely,

David H. Weiner, President, CWA Local 1081
