Step III Contractual Grievance
Unprotected Vehicles
Article I. Purpose
Article XLIX. Safety of Staff

Dear Mr. Ramos:

CWA Local 1081 submits this Step III Contractual Grievance on behalf of our members assigned to park their personal vehicles within the County-provided lot located on Fulton Street , Newark . Director Nigro's attached Step II Class Action Contractual Grievance denial response is unacceptable to CWA Local 1081 and our adversely affected members. The landlord of the parking lot has a legal contractual responsibility and liability with the County of Essex , as part of the County's lease for the office space located within 18 Rector Street, Newark , to do all he may to ensure the safety and inviolability of our affected members' personal vehicles:

  1. Construction is transpiring on a building that adjoins the lot.

  2. Our members' vehicles parked there are being covered with a white dust and small rocks.

  3. The workers performing the construction wear protective gear to protect them from the dust their work spawns, yet the lot's owner and his operatives have taken no measures to place plastic sheeting over the area of the building upon which they work so as to minimize the dust and rock effluence.

As the resolution to this grievance, CWA Local 1081 respectfully demands consists of the following:

  1. The County shall speak to the landlord and request he speak with the construction crew about putting up plastic sheeting over the area of the building upon which they work so as to minimize or eliminate the dust and rock effluence.

  2. Inasmuch as it's possible the landlord of the lot, who is also the landlord of 18 Rector Street where our affected members are assigned to work, may well have financial interests in the building being worked upon, it would make it quite more facile for him to grant the request we have made in number one found immediately above.

  3. In the future, when construction work such as this, or road work, occurs within the area of the lot and management has advanced knowledge of it the County shall make all good faith effort to attempt to ensure the safety and sanctity of our affected members and their vehicles.

We seek a hearing, in this regard.
