September 20, 2007Bruce Nigro, Director Step II Class Action Contractual Grievance Dear Mr. Nigro: CWA Local 1081 submits this Step II Contractual Grievance on behalf of all of our Union's members to protest the attached memorandum of September 5, 2000 written by Deputy Director Yvonne Davis to "All Division Directors, Administrative Supervisors, Unit Managers and Supervising Clerks Department of Citizen Services" entitled "Revised Memorandum-Request for Excused Tardiness". Specifically, the attached form accompanying Ms. Davis' memorandum, entitled "Reason for Absence or Illness" appears require our members to produce physicians note stating they were ill whenever they complete the attached "Request for Excused Tardiness" form. Inasmuch as the vast majority of our members who complete the form because they were "late reporting for work due to some condition or event beyond their control" do so for reasons other than illness. This fact renders the requisite "Reason for Absence or Illness" form illogical, inequitable and unjustifiable. Therefore, the resolution CWA Local 1081 respectfully demands to this grievance consists of the following: The apparent requirement all members of CWA Local 1081 must complete the "Reason for Absence Due to Illness" form when they complete the "Request for Excused Tardiness" form shall apply only when illness is alleged as the precipitating justification for the tardiness. Management, once concurring with our Union 's position in this regard, shall issue a memorandum to all staff of the Division of Welfare specifying that the "Request for Excused Tardiness" form shall apply only when illness is alleged as the precipitating justification for the tardiness.
