Dear Mr. Nigro:

CWA Local 1081 submits this Step II Class Action Contractual Grievance on behalf of all of our members managerially required to utilize the Automated Time and Attendance Record Keeping System, exclusively effective July 1, 2008, as well as to complete the attached County of Essex Employee Leave Request Form. As the system and the form are described within Office of Medicaid Services Frank Palmieri’s attached memorandum of June 25, 2008, entitled “The Automated Time and Attendance Record Keeping System MORE THINGS YOU NEED TO KNOW”, our Union takes ultimate umbrage with their following respective provisions:

Our members having to submit the form is insultingly counterproductive, particularly as vacation days are managerially mandated to be requested within March of each year and are then redundantly required to be requested anew each time taken by noting them upon the form.
The entire Automated Time and Attendance Record Keeping System is a shameful sham, inasmuch as our Union obtained and circumspectly scrutinized a memorialized recounting of all of our members’ then available “swipe card” records from the County through an OPRA request and discovered myriad inconsistencies and errors apparently precipitated by the questionable quality of the system’s software.
The callous capriciousness of the system shall result in the iniquitous, injurious and indefensible imposition of docking and or discipline upon our members even as the County has been aware of the system’s imperfections since its very initial installation.

The resolution CWA Local 1081 respectfully demands to this grievance consists of the County halting the use of the Automated Time and Attendance Record Keeping System as the sole determinant of recording employees as well as halting its use of the County of Essex Employee Leave Request Form.

We seek a hearing, in this regard.
