Re: Step II Class Action Contractual Grievance

       Office of Medicaid Services

       Perilously Cluttered Record Room

       Article I. Purpose

      Article XLIX. Safety of Staff

Dear Mr. Nigro:

CWA Local 1081 submits this Step II Class Action Contractual Grievance on behalf of our members assigned to, and having to utilize, the record room located within the Office of Medicaid Services due to the perilously cluttered condition of that area. One of our Family Service Worker members was injured, on January 8, 2008, within the record room as a result of the muddle maintained therein.

Attached, please find three (3) photographs CWA Local 1081 has taken of the site of recent that attest to its deplorable and dangerous circumstance.

The resolution CWA Local 1081 respectfully demands to this grievance consists of the following:

a)      The County shall ensure the immediate transfer of case files from the floor and the tops of the file cabinets within the cited record room.

b)      The County shall ensure sufficient alternative storage space is secured within which to maintain the files that have been superfluously stored upon the floor and upon the tops of the file cabinets within the cited record room.

CWA Local 1081 requests a hearing, in this regard.

Sincerely,

David H. Weiner, President

CWA Local 1081
