SUBJECT: Overtime Calculations

CWA Local 1081 has recently been notified by a number of our Union’s members that they did not believe the County has been properly calculating their overtime payments. This follows CWA Local 1081 having reached a settlement of our federal lawsuit against the County that required it provide retroactive compensation to those underpaid overtime within the two years prior to the filing of our suit and that it properly prospectively calculate overtime compensation.

Having notified our Union’s attorney, Annmarie Pinarski, Esq., of these events, she contacted the County and the following represents their rapidly emailed response:

Bill Friel, the Payroll Manager, stated that the change over to the new OT calculation should be fully implemented by the end of October. Any Division of Welfare employees that work OT before then will receive retro pay for the differential.

Therefore, the county acknowledges that it has not yet implemented the changes, but that it will by October, and that all CWA Local 1081 members who worked overtime prior to the implementation will receive retroactive pay.
